Several situations have brought to light a legal and ethical issue that should be of concern to all Medical Physicists. Medical Physicists on leaving an institution have an obligation to leave all information for which compensation was made. Documentation should be left in an intelligible, legible order and format. It is the position of the Ethics Committee that materials generated as well as the notes from work compensated by the institution is the property of the institution paying for the salary or consulting fee of the individual doing the work. These materials should be left in the possession of the institution unless otherwise instructed by the institution.

If the Medical Physicist terminates:

1. The Medical Physicist must give sufficient notice to allow for continuity of service. Under normal conditions, 30 days is considered sufficient.

2. The Medical Physicist must maintain confidentiality of propriety information.

3. The Medical Physicist upon termination must see that all professional documentation, reports, and equipment belonging to the institution or prepared for the institution during employment are returned to the institution.

For protection against the possibility of premature termination, a Medical Physicist would be well advised to contemplate the following in a contractual agreement:

1. The employer should provide a personal interview and provide specific reasons for the separation.

2. Additional compensation should be expected and correspond to the number of years of service if premature termination should occur.

3. An effort should be made by the employer to relocate the employee.

4. An option for retirement in lieu of termination should be offered by the employer.

5. Continuing liability coverage for the employee should be provided by the employer for the employee for work performed at the institution prior to termination.
